Federal Law No. 37 of 1992 on Trademarks, as revised by Federal Law No. 8 of 2002 This legislation controls the registration and protection of trademarks. It establishes methods for trademark registration, defines trademark rights, and specifies processes for dealing with infringement
- Federal Law No. 44 of 1992 on Copyright and Neighboring Rights (as revised by Federal Law No. 7 of 2002): This legislation protects literary, artistic, and scientific creations, including software and databases. It determines the rights of writers, performers, and producers.
- Federal Law 15 of 2002 on Patents and Industrial Designs (as revised by Federal Law 13 of 2004): Patents and industrial designs are registered and protected under this regulation. It determines the extent of patentable innovations, as well as patent holders’ rights.
- Federal Law No. 19 of 2016, on Commercial Agencies: Although this legislation is primarily concerned with commercial agencies, it also includes measures for the protection of trade names and other intellectual property aspects in business agreements.
- Federal Decree-Law No. 36 of 2021 on Industrial Property: This latest legislation seeks to strengthen the protection of industrial property rights, such as patents, trademarks, and designs, while also aligning UAE intellectual property rules with worldwide norms.
Key Aspects of IP Protection.
1. Trademarks
Trademarks in the UAE can be registered with the Ministry of Economy. The registration procedure consists of filing an application, taking an examination, and gaining permission. Once registered, a trademark is protected for 10 years and can be renewed forever. The protection extends not just to the trademark but also to its commercial usage.
2. Copyrights
Copyright protection in the UAE is automatic upon the production of a work, and while registration is optional, it gives extra benefits such as legal presumption of ownership. Copyright covers all original literary, artistic, and scientific works, including software and databases. The protection lasts for the author’s lifetime plus fifty years.
3. Patents
Patents must be registered with the Ministry of Economy to be protected. The patent law grants innovators exclusive rights for 20 years from the filing date, allowing them to restrict anyone from creating, using, or selling the protected invention without permission. Patents must satisfy the requirements of originality, inventive step, and industrial applicability.
4. Industrial Designs.
Industrial designs, which encompass the aesthetic element of objects, can be registered to preserve their visual look. Registration provides ten years of protection, which may be renewed for an extra time. This protection forbids unauthorized usage or replication of the design.
Enforcement of Intellectual Property Rights.
1. Administrative measures.
IP rights holders can seek administrative remedies from the Ministry of Economy, which has the jurisdiction to investigate and prosecute IP infringement. This involves sending warnings, performing inspections, and taking action against infringers.
2. Judicial remedies.
The UAE courts plays an important role in enforcing IP rights. Rights holders can sue in civil court for intellectual property infringement. To address intellectual property issues, the UAE has specialized courts in specific emirates, such as Dubai. Courts can issue injunctions, reparations, and orders for the destruction of infringing items.
3. Customs Enforcement.
The Federal Customs Authority is authorized to enforce intellectual property rights at borders. To prevent counterfeit items from being imported, rights holders can register their intellectual property with customs officials. Customs can seize and confiscate violating items, adding another layer of protection.
4. Alternative Dispute Resolution (ADR)
ADR techniques, such as arbitration and mediation, are increasingly being utilized to address intellectual property conflicts. The Dubai International Arbitration Centre (DIAC) and the Abu Dhabi Commercial Conciliation and Arbitration Centre (ADCCAC) are noteworthy organizations that provide specialized arbitration services for intellectual property matters.
